Brooks reaches trademark agreement with Nike

brooks sports running shoestailwind logoLast month, TheFinalSprint.com reported that Brooks Sports, Inc. filed a lawsuit against Nike, Inc., Exeter Brands Group, LLC and Payless ShoeSource, Inc., citing significant trademark infringement and unfair competition relative to the Tailwind athletic footwear line.

However, the two shoe and apparel manufacturers were able to reach a mutually acceptable agreement and the matter seems resolved, at least for now.

Tamara Hills, Corporate Communications Manager at Brooks, wrote:

“We have now officially resolved our differences to mutual satisfaction of all parties. Exeter/Nike will take steps to distinguish its products from Brooks in the market, and it will modify the Tailwind Logo to mitigate potential consumer confusion between their brand and ours.”

Satisfied with the resolution of this matter, Brooks President and CEO Jim Weber also responded by saying:

“We are very pleased with this outcome and our ability to protect our brand and our customers in this way … We look forward to continuing to deliver the performance running product our customers have come to expect and respect from Brooks.”

  1. nike made an anouncement in 03/07 that they would make a running shoe for payless. Well i’ve been trying since then to locate it . All i got was that the name was trailwind. nike nor payless could tell me more about it Why cause this frustration to me and others ? TOdat i came across this website to fin the clandestine reasone . shame /shame .shame Why string me along like that ? what you did was plain manipulation !!!!
